MUNICIPALITY OF THE DISTRICT OF BARRINGTON 

Barrington RecPlex Membership Agreement

Membership provides shared access to designated RecPlex amenities, drop-in activities and program spaces, subject to schedules, capacity, safety requirements and this agreement.

Membership Use

1  Personal membership and PlayFinder account. Membership is issued to the named member and may not be transferred, shared or used by another person. Every member must be registered through a valid PlayFinder account or member profile. A parent or guardian manages the registration for a minor. Members must check in as directed and provide proof of membership or identification when requested.

2  Included access and guests. A membership includes only the amenities, drop-in activities and other benefits identified for the purchased membership type. A guest must pay the applicable daily user fee unless participating in a scheduled program that permits access. Published schedules and availability may change. Registration, additional fees or separate terms may apply to classes, rentals, special events and other services.

3  Program spaces. Members may use designated program spaces during posted member-access times when the spaces are open, appropriately staffed where required, and not booked, programmed, maintained or otherwise unavailable. Access is first come, first served and does not create a reservation or exclusive use. Facility staff may limit or relocate an activity because of capacity, safety, operational needs or the intended use of a space.

4  Care of the facility. Members must use spaces, equipment and furnishings only as intended; leave them clean and in the condition found; and immediately report damage, hazards, injuries or concerns to staff. The member may be responsible for loss, damage or extraordinary cleaning caused by the member or by a child or guest under the member's supervision.

Safety and Conduct

5  Rules and staff direction. Members must follow posted rules, activity-specific requirements and reasonable directions from RecPlex staff. Respectful behaviour is required. Harassment, discrimination, threats, violence, unsafe conduct, deliberate damage and conduct that substantially interferes with another person's use of the facility are not permitted.

6  Ability to participate. Members are responsible for choosing activities appropriate to their abilities and health, using appropriate footwear and equipment, and stopping an activity when they cannot participate safely. A member with a health concern should obtain appropriate medical advice before participating.

7  Children and supervision. Individual memberships are available beginning at age 6. A parent or guardian must authorize the membership and sign this agreement for every member under age 18. Children age 10 and under must be actively supervised at all times by a responsible caregiver, unless they are participating in a supervised program that states otherwise. Caregivers are responsible for the conduct and safety of children in their care. Age restrictions posted for particular spaces or activities must be followed.

8  Walking track. The walking track is an adult-only space during regular hours. Families may use it only during designated family walking times and for walking. Strollers, walkers and wheelchairs are welcome. Users must wear clean, dry footwear; follow the posted direction of travel; keep slower traffic to the inside and faster traffic to the outside; announce before passing; keep lanes clear; and avoid stopping on the track.

9  Substances. Smoking, vaping, cannabis, illegal substances and unauthorized alcohol are prohibited in the facility and wherever else municipal policy or law prohibits them.

Administration

10  Fees and cancellations. Fees are payable according to the terms shown at purchase. A member may cancel in writing within 7 calendar days of purchase for a full refund if the membership has not been used. After that period, a prorated refund based on complete unused months may be approved for a documented medical reason, relocation outside the service area, or an extended facility closure. Partial months are not refunded. No refund is provided when a membership is suspended or terminated for breach of this agreement. Temporary closures, maintenance, program changes, capacity limits and schedule changes do not normally qualify for a refund.

11  Suspension termination and appeal. The Municipality may warn a member, restrict access, suspend or terminate a membership when the member breaches this agreement or facility rules, creates a safety risk, fails to pay amounts owing, misuses membership access, or seriously or repeatedly disrupts facility operations or other users. Immediate action may be taken when reasonably necessary for safety. A member may appeal a suspension or termination by submitting a written request to the Director of Recreation for review.

12  Personal information. Memberships are registered and administered through the PlayFinder portal, which maintains privacy and security standards for its service. Personal information is collected and used to administer memberships, process payment, communicate service information, support safety and emergency response, and enforce this agreement. It will be handled in accordance with applicable municipal policy, PlayFinder terms and applicable law. Optional promotional communications may be declined or withdrawn separately.

Assumption of Risk and Release

PLEASE READ CAREFULLY. THIS SECTION AFFECTS LEGAL RIGHTS.

13  Assumption of risk. I understand that physical activity and use of recreation facilities involve inherent and other risks, including collision, falls, equipment failure, the actions of other people, illness, personal injury, disability, death, and loss of or damage to property. I freely accept and assume these risks.

14  Emergency assistance. If I am unable to consent and RecPlex staff reasonably believe urgent assistance is required, I authorize the Municipality and its employees, volunteers and contractors to obtain or consent to emergency medical assistance for me. I understand that I am responsible for related costs not covered by insurance.

15  Release of claims. In consideration of being permitted to use the RecPlex, I waive claims against and release the Municipality of the District of Barrington and its elected officials, employees, servants, agents, volunteers, contractors, successors and assigns from liability for loss, damage, injury or expense arising from or related to my participation or facility use, including claims arising from negligence, breach of contract, breach of a statutory duty of care, or breach of the Occupiers' Liability Act, except to the extent that a release is prohibited by law.

16  Indemnity. I agree to indemnify and hold the persons and entities listed above harmless from claims, liability, loss or expense for personal injury, death or property damage suffered by a third party and arising from my acts or omissions, or those of a child or guest under my supervision, except to the extent caused by the Municipality's negligence or otherwise prohibited by law.

Acknowledgement

By submitting,, I confirm that I have read and understood this agreement, have had the opportunity to ask questions, and agree to be bound by it. I understand that this agreement includes a waiver and release of legal rights. If I sign for a minor or dependent adult, I confirm that I am authorized to do so and agree to the supervision and responsibility provisions above.

RELEASE OF LIABILITY, WAIVER OF CLAIMS & ASSUMPTION OF RISK AGREEMENT
BY SIGNING THIS DOCUMENT YOU ARE WAIVING LEGAL RIGHTS

1. I am aware of and freely accept all risks including the possibility of illness, personal injury, disability, death, and
   property loss and damage.
   2. I am physically, emotionally, mentally and otherwise able to fully participate and will follow all rules of participation.
   3. I authorize the Municipality of the District of Barrington (the “Municipality”) and its employees, volunteers and
   contractors to consent to emergency medical treatment for me if they consider it appropriate to do so.
   4. I waive all claims against the Municipality, its employees, councillors, servants, agents, successors and assigns (the
   “Releasees”) and release them from all liability for loss, damage, injury or expense arising out of or related to my
   participation, due to any cause whatsoever, and the negligence, breach of contract, breach of statutory duty of care, or
   breach of the Occupiers Liability Act, SNS 1996, c 27, on the part of the Releasees.
   5. I agree to hold harmless and indemnify the Releasees from all liability for personal injury, death or property damage to
   any third parties arising out of or related to my participation, due to any cause whatsoever.
   6. I understand that in consideration of my participation I am giving up certain substantial legal rights including the right
   for me or anyone acting on my behalf to sue the Releasees for any damages including, but not limited to, damages
   related to illness, personal injury, disability, death, and property loss and damage.
