ACKNOWLEDGMENT of RISK and RELEASE of LIABILITY- For Participants 19 Years or Older.

Every person must read and understand this Waiver before participating in Farm & Equine Activities organized by St.Marys Horse & Farm Club. This Waiver encompasses all Activities organized by St Marys Horse & Farm Club in the calendar year 2026. To: St Marys Horse & Farm Club, its directors, officers, members, employees, volunteers, and
site property owners. (collectively called "SMHFC"):

1. I Understand there are Inherent DANGERS, HAZARDS and RISKS, (collectively called RISKS) associated with Farm & Equine Activities and injuries resulting from these RISKS are a common occurrence.
2. I Acknowledge that the Inherent RISKS of Farm & Equine Activities mean those DANGEROUS conditions which are an integral part of Farm & Equine Activities, including but not limited to:
   (a) the propensity of any horse to behave in ways that might result in injury, harm-or death to persons on or
   around them and to potentially collide with, bite or kick other animals, people, or objects.
   (b) the unpredictability of a horse's reaction to such things as sounds, sudden movement, tremors, vibrations,
   unfamiliar objects, persons or other animals and hazards such as subsurface objects; and
   (c) the potential for other participants to act in a negligent manner that might contribute to injury to themselves or
   others, such as failing to act within their ability or to maintain control over a horse.
3. I Freely Accept and Fully Assume All Responsibility for the inherent RISKS and the possibility of personal
   injury, death, property damage or loss resulting from my participation in Farm & Equine Activities.
4. I Acknowledge that it remains my Sole Responsibility to act in such a manner as to be responsible for my own safety and to participate within my own limits.
5. In addition to consideration given to SMHFC for my participation in Farm & Equine Activity, I and my heirs, executors, administrators and assigns (collectively called my "Legal Representatives") agree:
   (a) to Waive any and all Claims that I might have against SMHFC; and
   (b) to Release the SMHFC from any and all Liability for any loss, damages, injury, or expense that I or my
   Legal Representatives might suffer as a result of my Participation due to any cause whatsoever including any negligence on the part of SMHFC; and
   (c) to Hold Harmless and Indemnify SMHFC from any and all liability for property damage or personal injury to any third party which might result from my participation in Farm & Equine Activities.
6. I agree that this waiver and all terms contained herein are governed exclusively and in all respects by the laws of
   Nova Scotia-and I kereby irrevocably submit to the exclusive jurisdiction of the courts of Nova Scotia.
7. I have been offered a copy of this Waiver, and I have been advised to read it carefully, and I confirm that I have
   had sufficient time to read and understand this Waiver in its entirety.

The parent/ guardian must read and understand this Waiver before participating in Farm & Equine Activities organized by St. Marys Horse & Farm Club. This Waiver encompasses all Farm & Equine Activities organized by St Marys Horse & Farm Club in the
calendar year 2026. To: St Marys Horse & Farm Club, its directors, officers, members, employees, volunteers, and site property owners. (collectively
called "SMHFC"):

1. I am the Parent I Guardian of the Infant Participant and am executing this waiver on behalf of the Child/Youth Participant in my capacity as Parent / Guardian and with the intent that this Waiver be binding on myself and the Infant Participant for all legal
purposes.

2. I Understand there are Inherent DANGERS, HAZARDS and RISKS, (collectively called RISKS) associated with the Child/Youth Participant's Farm & Equine Activities and injuries resulting from these RISKS are a common occurrence.

3. I Acknowledge that the Inherent RISKS of Farm & Equine Activities mean those DANGEROUS conditions which are an integral part of Equine Activities, including but not limited to:
(a) the propensity of any horse to behave in ways that might result in injury, harm or death to persons on or around them and to potentially collide with, bite or kick other animals, people, or objects;
(b) the unpredictability of a horse's reaction to such things as sounds, sudden movement, tremors, vibrations, unfamiliar objects, persons or other animals and hazards such as subsurface objects; and
(c) the potential for other participants to act in a negligent manner that might contribute to injury to themselves or others, such as failing to act within their ability or to maintain control over a horse.

In addition to consideration given to SMHFC for the Child/Youth Participant's participation in Farm & Equine Activity, I and my heirs, executor, administrators and assigns, as well as the Infant Participant and his/her heirs, next of kin, executors, administrators and assigns (collectively called our "Legal Representatives") agree:
(a) to Waive any and all Claims that the Infant Participant might have against SMHFC; and
(b) to Release the SMHFC from any and all Liability for any loss, damages, injury, or expense that I, the Child/Youth Participant, or our Legal Representatives might suffer as a result of the Child/Youth Participant's Participation due to any cause whatsoever including any negligence on the part of SMHFC; and
(c) to Hold Harmless and Indemnify SMHFC from any and all liability for property damage or personal injury to any third party which might result from the Child/Youth Participant's participation in Farm & Equine Activities.

6. I agree that this waiver and all terms contained herein are governed exclusively and in all respects by the laws of Nova Scotia and I hereby irrevocably submit to the exclusive jurisdiction of the courts of Nova Scotia.

7. I have been offered a copy of this Waiver and I have been advised to read it carefully and I confirm that I have had sufficient time to read and understand this Waiver in it's entirety.
